Your 485 Was Replaced by a Later Visa Grant: Why It Happens and What to Do

A common high-stakes scenario: an applicant has multiple visa applications in the system at the same time — for example, a Visitor visa lodged before a Subclass 485 application. The Visitor visa was lodged as a precaution against the student visa expiring before English-test results came through. Then the English result arrives, the 485 is lodged and granted, and the applicant forgets to withdraw the pending Visitor visa application. Weeks or months later, the Visitor visa is granted — and replaces the much more valuable 485.

Why this happens

When the Department grants a visa to an applicant who already holds a substantive visa, the new visa generally takes effect in place of the previous one. If the older application was for a less beneficial visa (a Visitor visa vs a 485, for example), the holder loses the better visa’s entitlements — work rights, study rights, longer duration, post-study pathway potential — and is left on the more limited Visitor visa instead.

The lesson: withdraw pending applications immediately

  • The moment a better visa is granted, withdraw every still-pending application you have in the system
  • Set a reminder for the day of grant — withdrawal is a 5-minute task in ImmiAccount
  • Don’t assume the Department will see your file holistically — case officers process the application in front of them on its own merits
  • Where you lodged a precautionary application, document why and have a clear plan to withdraw it once the primary application succeeds

What if the better visa has already been replaced?

Once the later visa has been granted, the earlier visa is gone in the ordinary course. Options to consider:

  • Judicial review at the Federal Circuit Court — arguable grounds include jurisdictional error, failure to consider relevant circumstances (the existence of the more beneficial visa), or breach of natural justice. Time limit is typically 35 days from the decision being made.
  • Ministerial Intervention request — discretionary, with no statutory right of grant; success is rare but possible in compelling circumstances
  • Lodge a fresh application for the visa class that was lost — practical where the applicant still meets the criteria (e.g. fresh 485 if within the post-study window)
  • Engage with the Department promptly — early correspondence flagging the issue is preferable to delayed action

The jurisdictional error argument

Where the Department’s file shows that the applicant already held a more beneficial visa at the time the lesser visa was granted, an argument can be made that the case officer failed to consider a relevant circumstance (the existence of the better visa) before granting the lesser one. This is a question of law potentially reviewable in the Federal Circuit Court. The 35-day window from decision is tight — act fast.

Prevention checklist

  • Maintain a visa application register — list every application you have on foot, with status
  • Set conditional reminders — when application X is granted, withdraw applications Y and Z
  • Communicate clearly with clients — if they have multiple applications pending, explain the withdrawal trigger
  • Watch ImmiAccount notifications closely — a grant on a stale application can land at any time

Frequently asked questions

How quickly does the new grant take effect?
Generally from the date of grant. The earlier substantive visa ceases at that point.
Can I reverse the replacement myself?
Not by withdrawing the lower-grade visa after grant — it’s already taken effect. Options are limited to judicial review, Ministerial Intervention, or fresh application.
What’s the 35-day judicial review deadline?
Federal Circuit Court applications for judicial review of migration decisions must generally be lodged within 35 days of the decision being made. This is strict.
Does the Department warn me before granting?
No. Visa grants are made on the file before the case officer. There is no automatic check against your other pending applications.
How do I withdraw a pending visa application?
Via ImmiAccount: open the application, choose to withdraw, confirm. Once withdrawn, the application is gone — there is no automatic grant.

Final word

A “replaced” visa is most often the result of a pending lower-grade application being granted after the holder secured a better visa. The fix is procedural and immediate: withdraw every still-pending visa application the moment you secure a better one. When the worst has already happened, judicial review or fresh application are the remaining paths — both tight on time.
