Sponsoring an Existing 482 Visa Holder: New Nomination Strategy

new sponsor 482 visa

When a Temporary Skill Shortage visa holder seeks to change employers, the new sponsor must lodge a fresh nomination. This guide explains how a new sponsor 482 visa works when an existing 482 holder changes employers.

How to Sponsor an Existing 482 Visa Holder

Timing the nomination and visa application correctly ensures the worker remains lawful and can transition smoothly. Here is a suggested plan:

• Lodge the new nomination about two weeks before the worker’s current visa expires.

• Apply for the new 482 visa before the existing visa expires. The nomination and visa applications are linked.

• Under condition 8607, a 482 holder can work for a new sponsor for up to 60 days without a formal nomination, but recent policy allows up to 180 days while the new nomination is being processed.

A new sponsor 482 visa arrangement allows the worker to change employers without breaching visa conditions.

During this period the applicant must not be unemployed for more than 90 days in total, but they can work for the proposed sponsor. Following this approach allows the worker to remain employed and lawful while the Department processes the new nomination. As regulations can change, consulting a migration agent ensures compliance with current conditions. Employers should also ensure that payroll, position duties, and work location align with the new nomination details. Any inconsistency can delay processing or trigger additional requests from the Department.
