Updating the Department After Marriage on a Partner Visa

partner visa marriage update

Partner visa marriage update concerns are common when couples marry after lodging a de facto partner visa application.

As a migration agent at VisaTasker I often assist couples who lodged a partner visa as de facto partners and then decide to marry. People worry that their application might be jeopardised or that they need to start again. Fortunately, the Department of Home Affairs (DHA) treats a marriage as an update rather than a new application, provided you inform them correctly.

A partner visa marriage update does not require a new application when the Department is informed correctly.

Partner Visa Marriage Update Using Form 1022

Once you are married, you should complete Form 1022 (Notification of Changes in Circumstances) and supply a copy of your marriage certificate. Submitting this form lets DHA know that your relationship has changed from de facto to married so they can assess your application accordingly. You do not need to lodge a new partner visa. Your case officer will simply assess the relationship on the basis of marriage instead of de facto. There is no penalty for marrying after lodging the application.

The key is to update the Department as soon as possible. Attach the marriage certificate and any other relevant evidence of your ongoing relationship. The process is administrative – you are not re-applying. Once the update is acknowledged, your application proceeds on the usual pathway. If you have any questions about completing Form 1022 or gathering the right documents, a registered migration agent can guide you.

Completing a partner visa marriage update promptly ensures the application is assessed on the correct relationship basis.

Why Updating Your Partner Visa Matters

Keeping the Department informed of changes to your relationship status is a core visa obligation. Failing to notify Home Affairs of a marriage can delay processing or lead to requests for further information. A timely partner visa marriage update helps ensure the case officer assesses the relationship accurately and avoids unnecessary complications during decision-making.
