Visa Condition 8579 Explained: Living Regionally for 491 & 191 Visas

Understanding Visa Condition 8579
Visa condition 8579 applies to provisional skilled regional visas such as the Skilled Work Regional (subclass 491) and Skilled Employer Sponsored Regional (subclass 494). When this condition is attached, you and any family members holding the visa must live, work and study only in a designated regional area. Designated regional areas include most of Australia but exclude major cities like Sydney, Melbourne, Brisbane, the Gold Coast and Perth. The condition applies for the entire duration of your provisional visa and continues until you are granted a permanent visa.
Designated Regional Areas & Exclusions
The Migration Amendment (New Skilled Regional Visas) Regulations make clear that while you are on a 491 or 494 visa you must have your principal place of residence in a regional area. You can travel anywhere in Australia for holidays or to visit family, but you cannot move your home or main workplace to a non‑regional city. If your job requires travel to capital cities, keep evidence that you remain based in a regional location.
Compliance and Travel
Condition 8579 does not restrict travel within or outside Australia – you can holiday anywhere and you do not need permission to leave the country. However, you must return to your regional home and keep working or studying there. Non‑compliance may lead to your visa being cancelled and can jeopardise your eligibility for a permanent regional visa (subclass 191).
Pathway to Permanent Residency
To transition from a 491 or 494 visa to permanent residency through the subclass 191, you must show that you complied with condition 8579 for at least three years. Evidence includes residential leases, utility bills, tax records and employment contracts. If you change jobs, ensure the new role is also located in a designated regional area. You cannot escape condition 8579 by applying for a visitor visa or different bridging visa; the obligation is tied to your provisional visa and remains in force.
Practical Tips
Keep comprehensive evidence of your address and employment in the regional area.
Notify your nominating state or territory of any change in circumstances.
Seek advice before moving to a different region or employer to ensure the area is still classified as regional.
